1. Acceptance of Terms

By downloading, installing, or using the Weather I Need application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Palms Yazılım Ticaret Limited Şirketi ("we", "us", "our").

2. Description of Service

Weather I Need is a mobile application developed and operated by Palms Yazılım Ticaret Limited Şirketi that allows users to search for cities and destinations worldwide based on specific weather conditions (sunny, rainy, snowy, windy) within a selected time period.

Weather data is sourced from Open-Meteo, an open-source weather API. City data is sourced from GeoNames. Map data is provided by OpenStreetMap contributors.

3. Weather Data Disclaimer

Important: Weather forecasts are estimates only.

Weather forecasts are inherently uncertain and may be inaccurate. The weather information provided by this App:

• Is sourced from third-party forecast providers and is provided "as is" without warranty of any kind.
• Is not guaranteed to be accurate, complete, or current.
• May differ significantly from actual weather conditions at any location.
• Should NOT be used as the sole basis for safety-critical decisions, travel planning that cannot be changed, outdoor activities in extreme conditions, agricultural, maritime, or aviation operations, or any situation where inaccurate forecasts could cause harm.

Forecast accuracy decreases significantly beyond 7 days. The App displays forecasts of up to 16 days; forecasts beyond 7 days should be treated as approximate indications only.

Always consult official meteorological services and local authorities for weather information relevant to safety-critical decisions.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
• WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE APP OR ITS CONTENT, INCLUDING BUT NOT LIMITED TO: TRAVEL COSTS INCURRED IN RELIANCE ON WEATHER FORECASTS, PROPERTY DAMAGE, PERSONAL INJURY, OR LOSS OF PROFITS.
• OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, the above limitations apply to the fullest extent permitted by law.

5. Third-Party Links and Affiliate Disclosure

The App may display links to third-party travel booking services, including but not limited to booking platforms for hotels, flights, and rental cars.

Affiliate Disclosure: Some links to third-party services may be affiliate links, meaning we may receive a commission if you make a purchase through those links, at no additional cost to you. Affiliate links are clearly identified within the App.

We are not responsible for the content, privacy practices, or terms of service of any third-party websites or services. Your use of third-party services is governed by their respective terms and privacy policies.

6. Intellectual Property

The App, including its design, graphics, user interface, and original content, is owned by Palms Yazılım Ticaret Limited Şirketi and is protected by applicable intellectual property laws.

The App makes use of third-party open data and services:

You may not copy, modify, distribute, sell, or lease any part of our App or its proprietary content without prior written permission.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable regulations.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Interfere with or disrupt the App's servers or infrastructure.
• Misrepresent the source of weather information obtained through the App.
• Use the App in any manner that could damage, disable, or impair its functionality.

8. Service Availability

We do not guarantee that the App will be available at all times. The App may be temporarily unavailable due to maintenance, updates, or technical issues beyond our control. We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time without notice.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. We will indicate the date of the most recent update at the top of this document. Continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the App.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

For EU/EEA consumers: Nothing in these Terms affects your rights as a consumer under the laws of your country of residence. You may submit a complaint to your local consumer protection authority or seek assistance from your local consumer dispute resolution channels, where available.

For Turkish consumers: Bu Koşullar Türkiye Cumhuriyeti hukuku kapsamında geçerlidir. Tüketici haklarınız 6502 Sayılı Tüketicinin Korunması Hakkında Kanun kapsamında saklıdır.
